This Man Said A Wild Sexual Encounter Killed His Girlfriend, But Police Aren't Buying It

A Florida man who claimed rough oral sex killed his girlfriend has been acquitted of second degree murder charges. 

Sometime around October 28, 2015, 65-year old Robert Patterson and 60-year old Francisca Marquinez were in the middle of a steamy session of BDSM-esque rough sex when suddenly, Marquinez stopped breathing and died. At least, that's how Patterson explains the death of his girlfriend. Police, however, do not buy his story. Iouri Boiko, the Broward County medical examiner testified "that the cause of death could not be determined due to how badly the body was decomposed by the time they began the autopsy." 

Patterson failed to call authorities after Marquinez died and, instead, called his ex girlfriend who directed him to his lawyer, Ken Padowitz.


To prove rough oral sex killed his girlfriend, Patterson's lawyer motioned to show Patterson's erect penis. Even though the medical examiner said the cause of death was inconclusive, he did admit that death due to asphyxiation was a possibility. When Patterson wanted to show the jury how he killed his girlfriend with his huge penis, his motion was denied.

The medical examiner said, "She will kick, bite, do something to prevent the blocking of the airway. It's the normal reaction." To counter Boiko's testimony, Padowitz called on “Dr. [Ronald] Wright, an expert witness and former Broward County medical examiner who testified that … her death is consistent with being accidentally sexually asphyxiated during oral sex,” Padowitz wrote in the motion.

Marquinez's neighbors, Eddie and Christianne Pathik also weighed in, saying that Marquinez was unhappy in the relationship. Two days before she died, they were arguing, shouting at each other,” Eddie Pathik said, translating for his Portuguese-speaking wife. “She was trying to break off the relationship.” The autopsy revealed no bruises or signs of trauma to the victim.
